Welcome to DEMAND AI (https://dream.hmyk.ai). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Creator", or "Buyer") and DEMAND AI TECHNOLOGY PTE. LTD. ("Company", "we", "us", or "our"), a company registered in Singapore. By accessing our website or using our AI video generation and digital asset marketplace services (the "Services"), you agree to be bound by these Terms.

欢迎使用 DEMAND AI (https://dream.hmyk.ai)。本服务条款（"本条款"）是您（"用户"、"创作者"或"买家"）与在新加坡注册的 DEMAND AI TECHNOLOGY PTE. LTD.（"公司"、"我们"或"本平台"）之间达成的具有法律约束力的协议。通过访问我们的网站或使用我们的 AI 视频生成及数字资产代售服务（"服务"），即表示您同意受本条款的约束。

1. Account and Registration 1. 账号与注册

You must be at least 18 years old to use our Services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

您必须年满 18 周岁方可使用我们的服务。您有责任妥善保管您的账号凭证，并对您账号下发生的所有活动负责。

2. Marketplace & Revenue Share 2. 代售市场与收益分成

Pricing: Creators may set the price for their digital assets in United States Dollars (USD).

定价：创作者可以以美元 (USD) 为其数字资产设定出售价格。

Commission: We charge a 20% platform service fee on every successful transaction to cover hosting, AI generation infrastructure, and payment gateway costs. The Creator will receive 80% of the sale price.

佣金：我们将从每笔成功的交易中收取 20% 的平台服务费，以覆盖云存储、AI 算力及支付网关成本。创作者将获得售价的 80% 作为收益。

Payments & Payouts: All transactions are processed securely via our designated third-party payment processors (e.g., Stripe). Payouts to Creators will be subject to our withdrawal policies and any applicable cross-border transfer fees or taxes.

支付与提现：所有交易均通过我们指定的第三方支付网关（如 Stripe）安全处理。向创作者发放的收益需遵守我们的提现政策，并扣除适用的跨境转账手续费或税费。

3. Intellectual Property & Licenses 3. 知识产权与许可

Creator's Warranty: By listing an AI-generated video or asset, the Creator warrants that they own all necessary rights, titles, and interests (including copyrights and portrait rights) to the underlying materials used. The Creator assumes full legal and financial responsibility for any infringement claims.

创作者保证：创作者上架 AI 视频或素材，即保证其对所使用的底层素材拥有所有必要的权利、所有权和权益（包括版权和肖像权）。创作者对任何侵权索赔承担全部法律及财务责任。

Buyer's License (Strictly No Resale): Upon purchase, the Buyer is granted a non-exclusive, personal-use license to the watermark-free asset. Buyers are strictly prohibited from reselling, redistributing, or claiming ownership of the purchased assets. Violation of this clause will result in immediate account termination and forfeiture of funds.

买家许可（严禁倒卖）：购买成功后，买家将获得该无水印素材的非独家、个人使用许可。严禁买家转售、重新分发或声称拥有所购素材的所有权。违反此条款将导致账号立即被封禁并没收资金。

4. Disclaimer of Warranties & Liability 4. 免责声明与责任限制

Our Services, including third-party AI generation APIs, are provided "as is" without warranties of any kind. We shall not be held liable for the content generated by Users, nor for any indirect, incidental, or consequential damages arising from the use of our Services. We reserve the right to remove any content that violates these Terms or applicable laws without prior notice.

我们的服务（包括第三方 AI 生成接口）按"现状"提供，不作任何形式的保证。我们对用户生成的内容不承担任何责任，也不对因使用我们的服务而产生的任何间接、附带或后果性损害负责。我们保留在不事先通知的情况下删除任何违反本条款或适用法律的内容的权利。

5. Governing Law & Dispute Resolution 5. 适用法律与争议解决

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.

本条款受新加坡共和国法律管辖并按其解释。因本条款引起的或与本条款有关的任何争议，均应提交新加坡法院专属管辖。

6. Language Precedence 6. 语言效力

These Terms are provided in both English and Chinese. In the event of any conflict or inconsistency between the English version and the Chinese version, the English version shall prevail.

本条款提供中英文双语版本。若英文版本与中文版本之间存在任何冲突或不一致，应以英文版本为准。
